General terms and conditions of sale and use

These terms govern access to the QUADRA GALLERY online store and the purchase of products offered through it. Before placing an order, please read these terms, the Privacy Policy, the Shipping Policy and the Returns and Refund Policy.

The store uses Shopify’s technological infrastructure. Shopify provides technology and processing services but is not the seller of the products. The contractual relationship of sale is established exclusively between the customer and QUADRA GALLERY.
2. Scope and capacity to contract
These terms apply to purchases made through the online store by consumers and professional customers, without prejudice to any mandatory rights afforded to consumers.
To place an order, you must be at least 18 years old and have sufficient legal capacity to enter into a contract. The customer undertakes to provide accurate, complete and up-to-date information and to maintain the confidentiality of their account credentials, if an account is created.
3. Products and Fine Art editions
QUADRA GALLERY sells, among other products, Fine Art prints and garments featuring original designs.
Fine Art works are offered in limited editions. Unless otherwise stated on the relevant product page:

the total edition is limited to 30 copies, distributed across the available sizes;

each copy is individually signed and numbered;

each copy includes a Certificate of Authenticity and the QUADRA GALLERY embossed seal;

each work is printed on Hahnemühle paper using Fine Art giclée printing with pigment inks;
-
works are supplied unframed;
-
the specific edition number is allocated according to production order and availability and cannot be selected unless expressly stated otherwise.
Each product page provides information on the product’s essential characteristics, dimensions, materials, price and availability. Images are prepared to represent the artworks and products as faithfully as possible, although colour perception may vary slightly depending on the screen, its calibration and lighting conditions. Minor variations inherent to the paper, artisanal production, signature or hand numbering will not be considered defects where they do not materially alter the advertised characteristics.
4. Purchasing process and formation of the contract
Before completing an order, the customer can review the products, sizes, quantities, address, delivery method, charges and total price. The final purchase button entails an obligation to pay.
After receiving the order, QUADRA GALLERY will send confirmation to the email address provided. The contract will be deemed concluded once the order has been confirmed and payment has been authorised or, in the case of bank transfer, once the funds have been received.
QUADRA GALLERY may refuse or cancel an order only for justified reasons, such as actual lack of availability, impossibility of delivery, unauthorised payment, reasonable evidence of fraud or an obvious and recognisable error in the price or description. In such cases, the customer will be informed and any amounts already charged will be refunded without undue delay.
For payments made by bank transfer, the order will remain reserved for 48 hours. If payment is not received within that period, the reservation may be cancelled. The customer must include the order number and their name as the payment reference.
5. Prices, taxes and payment methods
Prices are displayed in euros and include applicable taxes unless clearly stated otherwise due to the nature or destination of the transaction. Shipping costs are displayed before the purchase is confirmed.
For shipments outside the customs territory of the European Union, the recipient may be required to pay taxes, customs duties or import charges imposed by the destination country. These amounts are not included in the price charged by QUADRA GALLERY unless expressly stated otherwise.
The store accepts the payment methods displayed during checkout, including cards processed through Shopify Payments, PayPal and bank transfer. QUADRA GALLERY does not retain full payment card details.
6. Availability and preparation
Units within a limited edition are subject to availability. If two orders are placed for the last available copy, priority will be given to the payment confirmed first. If it is not possible to fulfil an order that has already been paid for, the customer will be informed and the full amount will be refunded.
Fine Art works may be produced after purchase. The usual preparation time is 3 to 5 working days and includes printing, drying, protection, numbering, certification and packaging. This timeframe is indicative; the estimated delivery date or delivery window will be shown on the product page, in the Shipping Policy or during checkout.
7. Shipping, delivery and transfer of risk
QUADRA GALLERY delivers to the destinations enabled in the store. Available delivery methods, costs and estimated times are shown before the order is confirmed. Unless another timeframe is expressly agreed, delivery will be made without undue delay and, in any event, no later than 30 calendar days after the contract is concluded.
Transit times are estimates and may be affected by logistical incidents, customs procedures or circumstances beyond QUADRA GALLERY’s reasonable control. If a significant delay occurs, the customer will be informed and their statutory rights will be respected.
The risk of loss or damage does not pass to the customer until the customer, or a third party designated by them other than the carrier, takes physical possession of the order. The exception is where the customer independently appoints a carrier that was not offered by QUADRA GALLERY.
The customer must provide a complete and accurate delivery address. If an order is returned because the address provided was incorrect or because it was not collected following delivery attempts, the customer will be contacted to arrange a new shipment and, where applicable, payment of the actual costs involved.
8. Right of withdrawal
A consumer purchasing at a distance has 14 calendar days from receipt of the product to withdraw from the purchase without having to provide any reason.
To exercise this right, the consumer must send, before the expiry of the withdrawal period, an unequivocal statement or the form included at the end of these terms to hola@quadragallery.com. QUADRA GALLERY will acknowledge receipt of the request.
Once the withdrawal has been communicated, the consumer must return the product within the following 14 calendar days to:

Unless QUADRA GALLERY offers to collect the product or has stated otherwise, the consumer will bear the direct cost of returning it. For products that, due to their size, cannot normally be returned by post, the estimated return cost will be €50.
The product must be adequately protected for transport. Reuse of the original packaging is recommended, although it is not compulsory. The consumer will only be liable for any reduction in the value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and condition.
QUADRA GALLERY will refund all payments received, including the cost of the least expensive standard delivery method offered, within 14 calendar days of being informed of the withdrawal. QUADRA GALLERY may withhold the refund until the product has been received or until the consumer provides evidence of having returned it, whichever occurs first. The refund will be made using the same payment method originally used, unless expressly agreed otherwise and at no cost to the consumer.
Exceptions
The right of withdrawal does not apply to products made to the customer’s particular specifications or clearly personalised, such as commissioned artworks, special sizes, modifications to an artwork, dedications or other customisations expressly requested by the customer.
The mere printing of a catalogue artwork after an order has been received, in one of the standard sizes offered by QUADRA GALLERY, does not in itself remove the right of withdrawal.
The statutory right of withdrawal applies to consumers. Purchases made by companies or professionals for business purposes will be governed by the terms agreed and by applicable commercial law.
9. Damaged, incorrect or defective products
The customer should inspect the parcel upon receipt. If they notice transport damage, an incorrect product or any other issue, they should contact hola@quadragallery.com as soon as possible, preferably within the first 48 hours, quoting the order number and attaching photographs of the packaging and product.
This 48-hour period facilitates claims with the carrier but does not limit the consumer’s statutory rights.
Where a product is incorrect, arrives damaged or lacks conformity for reasons attributable to QUADRA GALLERY, any collection, replacement, repair, price reduction or refund legally due will be provided free of charge to the consumer, including any necessary transport costs.
10. Statutory guarantee of conformity
Products are covered by the applicable statutory guarantee of conformity. For sales to consumers in Spain, QUADRA GALLERY is liable for any lack of conformity existing at the time the goods are delivered and becoming apparent within three years of delivery.
Where legally applicable, the consumer may request repair or replacement and, where those remedies are not possible, are not carried out within a reasonable period or cause significant inconvenience, a price reduction or termination of the contract.
The guarantee does not cover damage resulting from improper use, handling, installation or storage contrary to the instructions provided, exposure to moisture, intense direct sunlight, extreme temperatures or interventions carried out by third parties, provided that such circumstances are the cause of the damage.
11. Cancellations before dispatch
If you wish to cancel or amend an order, please contact hola@quadragallery.com as soon as possible. QUADRA GALLERY will endeavour to accommodate the request before dispatch.
This provision does not limit the consumer’s right of withdrawal or any other statutory rights.
Personalised commissions cannot be cancelled once production has begun where the customer has been informed of this in advance and the statutory exception to the right of withdrawal applies.
12. Intellectual property
The texts, photographs, artworks, illustrations, designs, videos, trade marks, logos and other content available through the store belong to QUADRA GALLERY, the respective authors or their lawful rights holders and are protected by intellectual and industrial property law.
The purchase of a physical copy transfers ownership of that particular copy but does not transfer any rights of reproduction, distribution, communication to the public, transformation, commercial exploitation or any other intellectual property rights relating to the artwork.
The reproduction or use of store content beyond personal use permitted by law is prohibited without prior written authorisation.
13. Use of the website and user-submitted content
The website must be used lawfully and without damaging its operation, security, content or the rights of third parties.
Prohibited conduct includes, among other things, introducing malicious code, gaining unauthorised access, large-scale extraction of content, impersonation and using images or artworks to train, feed or exploit automated systems without authorisation where such use infringes rights or legally valid restrictions.
If a user voluntarily submits a review, photograph or comment for publication, they declare that they hold the necessary rights and grant QUADRA GALLERY a non-exclusive, royalty-free licence to reproduce and communicate that contribution through the store and the gallery’s channels for the purpose of publishing, moderating and promoting it.
The user may request that the contribution no longer be used in future publications, without affecting uses already lawfully made.
QUADRA GALLERY may remove unlawful, offensive, misleading content or content that infringes the rights of third parties.
14. Data protection, cookies and communications
The processing of personal data is described in the Privacy Policy. The use of cookies and similar technologies is governed by the Cookie Policy and the preferences panel available on the website.
Shopify and payment providers, carriers and other necessary service providers may process data in order to operate the store, handle payments, prevent fraud and deliver orders, in accordance with their respective functions and policies.
Marketing communications will only be sent where there is a lawful basis for doing so and will always provide a simple means of unsubscribing.
15. Website availability, links and liability
QUADRA GALLERY endeavours to keep the website available and its information up to date, but may carry out technical interruptions, maintenance or corrections.
Links to third-party websites are provided for the user’s convenience; each third party is responsible for its own content and services.
Nothing in these terms excludes or limits any liability or rights that cannot lawfully be excluded under applicable legislation.
QUADRA GALLERY will be liable for compliance with its statutory and contractual obligations, but not for failures caused exclusively by the customer, by third parties beyond its control or by circumstances of force majeure, without prejudice to the consumer’s mandatory rights.
16. Amendment and retention of these terms
QUADRA GALLERY may update these terms to reflect legal, technical or commercial changes.
The version applicable to each purchase will be the version accepted when the order is placed and will be provided, or made available for retention, on a durable medium.
If any provision is declared invalid or unenforceable, it will be deemed omitted to the extent necessary without affecting the validity of the remaining provisions.
17. Governing law, complaints and jurisdiction
These terms are governed by Spanish law, without prejudice to any protection afforded to consumers residing in other countries under applicable mandatory rules.

Official consumer complaint forms are available where legally required.
The parties will attempt to resolve any dispute in good faith. Where the customer is a consumer, jurisdiction will lie with the courts and tribunals determined by consumer protection law, including, where applicable, the courts of the consumer’s place of residence. Nothing in these terms requires the consumer to waive their statutory jurisdiction.
